IN THIS PRIVACY POLICY, "WE," "US," "ITS" AND "OUR" REFER TO APLIX IP HOLDINGS CORPORATION AND ITS AFFILIATES (collectively “AIP"), AND "YOU" AND "YOUR" REFER TO YOU.  Before using the website(s) published by us (the "Site(s)"), and any of our MyBeaconTM, HubeaTM , and other Bluetooth Low Energy-related products and services, containing the link to this policy, please read carefully this Privacy Policy ("Policy").


A.  Introduction


This Policy tells you how we use and protect personal information collected through use of the "Offerings", defined as the Site(s) and our products and services, including the Service (as that term is defined in the Terms of Use), that links to this Policy. This Policy does not apply to websites, applications, or services that do not display or link to this Policy or that display or link to different privacy policies or statements. This Policy covers only information that is collected through the Offerings and no other web sites, product or services that may be linked to or available via or from the Offerings or used in association therewith; nor does this Policy apply to practices of companies other than AIP. 


You expressly consent to our collection, storage, use and disclosure of your personal and non-personal information as described in this Policy and to all other terms herein.


Our Sites use cookies, and therefore use of the Offerings by you constitutes your acceptance of our use of cookies in accordance with this Policy.


B.  Information Collected


The following personal information about you may be collected and stored by us:


(i) name and identity, email address, physical and virtual and physical contact information (including for example your personal and business address), professional information, log-in data, and financial information, including credit card and/or bank account numbers;


(ii) information responsive to surveys or applications for employment, disclosed in resumes, or requested in order to provide brochures or information about our business, employment, products or services;


(iii) transactional information based on your activities with or on the Offerings;


(iv) shipping, ordering, billing and other similar information you provide to purchase or ship an item or service;


(v) community discussions, chats, dispute resolution, and correspondence sent to us;


(vi) computer sign-on data, statistics on page views and traffic to and from the Site;


(vii) other technical information or data collected from activity and traffic, including IP address, operating system and application version, device information, services used, beacons used for receiving and transmitting signals and content and the timing of such use, geolocation data, and standard web log information;


(viii) supplemental or additional information we may request from you in the event previous information you've provided cannot be verified; and


(ix)  information that you voluntarily provide to us, and information that we collect as per the Terms of Use.


C.  Purpose of Information


We may combine your information with information we collect from other sources to improve or promote the Offerings. You agree that we may use your personal information as specified in the Terms of Use, and to:


(i) fulfill the purposes disclosed when you provided your information to us and to provide the goods, services and applications you specified (that is, in order to facilitate accomplishment of the objectives of doing business with us);


(ii) provide, deliver, and collect payment for the services, products, and customer support you request;


(iii) review and process applications for employment;


(iv) resolve disputes, collect fees, and troubleshoot problems;


(v) prevent potentially prohibited or illegal activities, and enforce our Offerings-related agreements;


(vi) customize, measure, and improve our Offerings and their functionality, content and layout;


(vii) provide you with personalized content or recommendations;


(viii) contact winners of our rewards, presents, campaigns, and other activities that involve giveaways or prizes;


(ix) tell you about and conduct targeted marketing, events, campaigns, service updates, new programs and products, and promotional offers, based on product location and activity; and


(x) compare information for accuracy, and verify it with third parties.


Further, we may disclose personal information to respond to legal requirements, enforce contractual terms, to other entities in AIP in connection with a reorganization, merger, equity or debt financing, sale of assets, or other similar corporate transactions, respond to claims that content breaches the rights of others, or protect the rights, property, or safety or any person.


D.  Sharing Information


We may also share your personal information with:


(i) third parties when we have your consent to do so;


(ii) members of AIP, service providers or similar contractors to handle your personal information in accordance with the purposes of use, as described in sections B and C above, in order to process for us;


(iii) other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and solicited consent when using a specific service);


(iv) law enforcement or other governmental officials as required by applicable laws and regulations, including without limitation in response to a verified request relating to a criminal investigation or alleged illegal activity;


(v) other business entities  with which we have merged with, to which we have transferred a business unit or with which we have otherwise performed a corporate reorganization transaction, by which  your personal information is to be transferred to such business entity. 


To the necessary extent of accomplishing the above listed purposes, your personal information provided to us will be shared amongst our group companies in a digital format. Aplix IP Holdings Corporation, the parent company, is responsible for controlling the communal use of such information.


We may also share aggregated non-personally identifiable information publicly and with our partners, agents, customers and vendors. For example, we may share information publicly to show trends about the general use of our products and services.


E.  Your Use of the Offerings


Your user ID may necessarily be displayed throughout the Offerings and to the public. All of your activities as such will be traceable to your user ID. Please understand that if you link your name with your user ID, others will be able to personally identify your activities.


F.  Technical Features (including cookies)


The Site may utilize "cookies", which are small text files placed on your computer or device.  They are commonly used to make websites work, or to work more efficiently.  We use cookies to help the site function, analyze our web page flow, customize our services, gather analytic and other data, measure promotional effectiveness, and promote trust, security and safety.  The Site and certain features are only available through the use of cookies, and generally we need to use cookies to help identify you and maintain your signed-in status.

In addition, the Offerings may incorporate pixel tags, web beacons or other web site usage measurement technologies.  Such devices are used to collect other information, such as the identity of the applicable internet service provider, the user's IP address of his or her personal terminal device, the type of browser software and operating system in use, the date and time of site access, the website address, if any, from which the user linked to the Offerings, and other similar traffic-related information. Such information is used for the purposes described above. We may also aggregate such information with similar data collected from other users or disclose such aggregate information to third parties. However, we do not use such data in any way to create or maintain personal information from you.


G.  Password


Your password to access our Offerings, if any, deserves careful thought and protection.  Use unique numbers, letters, and special characters and do not disclose your password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf.  If your password has been compromised for any reason, you should immediately access your profile on the Site to change your password and notify us immediately.


H.  Your rights


You can see, review and change some of your personal information by logging into our websites.  You must promptly update your personal information if it changes or is inaccurate. We retain personal information from closed accounts in order to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Offerings-related agreements, and take other actions otherwise permitted by applicable laws and regulations or as specified elsewhere in this Policy.

Except as otherwise expressly included in this Policy, this document addresses only the use and disclosure of information we collect from you. 


J.  Children


The Offerings are not directed to those under 13 years of age, and we do not knowingly collect personal information from children. If you are younger than thirteen, please do not provide any personal information to us.  If a person 13 years of age or younger has provided personal information to us, a parent or guardian of such person should contact us so that we can remove such personal information from our database.  We reserve the right to limit participation in particular programs, offers or promotions to those over 18 years of age.


K.  Policy Changes


We may amend this Policy at any time in accordance with the Terms of Use; provided, however, if amendment is made to any provisions of “C. Purpose of Information”, then such amendment shall be notified to you or promulgated on our homepage.


L.  Data Security


We take appropriate technical and organizational measures to maintain the security of your personal information.  However please remember that any messages you send over the internet are not secure unless they are appropriately encrypted.  Despite our efforts, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information.


M. Response to Inquiries


We will respond to your requests to disclose, correct, cease using, delete, and cease providing to a third party your personal information appropriately in accordance with relevant laws and regulations. We will also handle inquiries and complaints in regard to our handling of personal information.
